Consumer Health Data Privacy Policy
This policy supplements Fytvio's general Privacy Policy and describes how ValueSpring LLC may collect, use, share, retain, and delete consumer health data, including rights that may apply under Washington's My Health My Data Act and similar laws.

Scope
Some information Fytvio processes may qualify as consumer health data because it identifies or may reasonably be linked to a consumer and relates to past, present, or future physical or mental health, fitness, wellness, nutrition, recovery, or related inferences. This policy applies where consumer-health-data law applies to Fytvio. It should be read together with our Privacy Policy.
Fytvio generally operates as a consumer fitness and wellness service and is not intended to provide medical diagnosis, treatment, or emergency monitoring.

Categories of consumer health data we may collect
- Workout, exercise, activity, steps, distance, calories, training load, exercises, sets, repetitions, resistance, duration, rest periods, schedules, and performance information.
- Sleep, resting heart rate, heart-rate trends, HRV, recovery, readiness-related signals, VO₂max, weight, body measurements, blood pressure, blood oxygen, and similar fitness or wellness metrics where available.
- Goals, AI-assisted plans, prepared or user-built plans where available, habits, routines, time-since trackers, reminders, streaks, elapsed-time history, notes, check-ins, and related information you choose to provide.
- Food and nutrition entries, descriptions, calories, macronutrients, water intake, supplements, favorites, and related nutrition information you choose to track.
- Optional health-condition, injury, pregnancy/postpartum, limitation, symptom, or safety context you choose to provide.
- Inferences Fytvio may generate from available information, such as readiness, recovery, training, trend, plan-progress, or habit-pattern insights.
- Coach messages or other user-provided text when the content itself relates to health, fitness, wellness, nutrition, or similar topics.

Sources of consumer health data
- You, including information you enter manually, create in plans or habits, or provide to AI-supported features.
- Apple HealthKit or Google Health Connect when you authorize access.
- Compatible devices or apps that write information into those authorized health platforms.
- Fytvio's own calculations, summaries, validations, and inferences based on available data.
- Published nutrition or reference sources used by supported features, where available.

Why we may collect and use consumer health data
- To provide requested dashboards, trends, readiness and recovery information, workouts, manual plans, habits, nutrition tracking, reminders, goals, plan generation and adjustment, coaching, and related app features.
- To personalize or contextualize AI-assisted features when you have provided the required consent.
- To sync, reconcile, validate, deduplicate, and troubleshoot health and fitness information.
- To provide safety guardrails, detect obviously inconsistent values, and indicate when available data may be limited.
- To secure the service, prevent abuse, investigate incidents, and comply with applicable law.
Fytvio does not use consumer health data for advertising or cross-context behavioral advertising.

Categories of consumer health data we may share and recipients
We may share only information reasonably needed for a requested feature, service operation, security, or legal obligation. Depending on the feature and your choices, recipients may include:
- Anthropic, OpenAI, or Google: selected prompts or relevant context for supported AI-assisted coaching, plan generation, summarization, readiness explanations, or nutrition estimation. The provider used may depend on Fytvio configuration or, for supported BYOK features, your selection.
- Supabase and Render: database, hosting, and application operations.
- Email and push-notification providers: delivery of reminders, account notices, or summaries. Notification content may include wellness information if you enable such notifications.
- Apple and Google: platform services you authorize or use, including HealthKit, Health Connect, sign-in, app-store subscriptions, and device speech recognition.
- Linked coaches or other trusted people you explicitly authorize: designated read-only information made available through the linking feature. Fytvio does not employ, credential, recommend, endorse, or supervise a linked person merely because they use the service.
- Authorities or other recipients required by law: only when disclosure is legally required or otherwise permitted under applicable law.
We may update service providers over time. Material changes affecting consumer health data will be reflected in this policy or otherwise communicated as required.

Sale of consumer health data
Fytvio does not sell consumer health data. We do not receive money or other valuable consideration in exchange for selling consumer health data to advertisers or data brokers.
If our practices were ever to change in a way that constitutes a sale under applicable consumer-health-data law, we would provide the notices and obtain the authorization required by law before such a sale.

Consent
Where required, Fytvio requests consent before collecting consumer health data beyond what is necessary to provide a product or service you requested. Fytvio also requests a separate choice before selected health or wellness information is transmitted to an AI provider for AI-assisted features.
You may withdraw consent for future processing through available in-app controls or by contacting us. Withdrawal may disable features that depend on the affected data or processing. Withdrawal does not require us to undo processing that was lawful before withdrawal, except where applicable law requires otherwise.

Your consumer health data rights
Depending on where you live, you may have rights to:
- confirm whether Fytvio is collecting, sharing, or selling your consumer health data;
- access consumer health data associated with you;
- receive information about the sources of consumer health data;
- receive a list of third parties and affiliates with whom consumer health data has been shared where required;
- withdraw consent for future collection or sharing;
- request deletion of consumer health data; and
- appeal certain denials of a rights request.
To exercise these rights, email info@valuespringllc.com. We may need to verify your identity before completing a request. We will respond within the time required by applicable law.
If we deny a request, we will explain the basis for the denial where required and provide an appeal method. If an appeal is denied, we will provide information about the appropriate regulator where required.

Retention and deletion
We retain consumer health data while your account is active and as reasonably necessary to provide, secure, and support requested features. After a verified deletion request, covered consumer health data is removed from active production systems subject to limited legally permitted retention described in our Privacy Policy.
Encrypted backup copies may persist temporarily according to infrastructure backup rotation. Where Washington's My Health My Data Act applies, consumer health data in archived or backup systems will be deleted no later than six months after we authenticate the deletion request.
Deleting the app from your device does not by itself delete your Fytvio account or app-store subscription.

Security
We use administrative, technical, and organizational safeguards designed to protect personal and consumer health data. These may include encrypted connections, access controls, authentication protections, logging, rate limits, and infrastructure security controls. No system can be guaranteed completely secure.

Changes to this policy
We may update this policy as Fytvio, our providers, or applicable law changes. Material changes affecting consumer health data will be communicated by reasonable means and, when required, we will obtain additional consent before the changed practice applies.
